FMLA and short term disability are not the same
Although people often apply for both at the same time, these programs serve different purposes.
Can both apply at once?
Often, yes. An employer may designate qualifying time away from work as FMLA leave while a disability plan separately determines whether the employee receives wage replacement. Approval under one program does not automatically mean approval under the other.
Who may qualify for FMLA leave
Under the federal Family and Medical Leave Act, an eligible employee of a covered employer may take up to 12 workweeks of leave in a defined 12 month period for certain family and medical reasons. Up to 26 workweeks may be available in a single 12 month period for qualifying military caregiver leave.
For the standard federal eligibility test, an employee generally must:
- Have worked for the employer for at least 12 months
- Have worked at least 1,250 hours during the 12 months immediately before the leave
- Work at a location where the employer has at least 50 employees within 75 miles
A qualifying reason may include the employee’s own serious health condition, caring for a spouse, child or parent with a serious health condition, birth or placement of a child, or certain military family needs. A serious health condition generally involves inpatient care or continuing treatment by a health care provider. Physical and mental health conditions may qualify when the legal and medical requirements are met.
What short term disability may cover
Short term disability is usually an employer benefit or private insurance policy, not a general guarantee of paid leave. A plan may pay a percentage of wages for a limited period when a covered illness, injury, pregnancy related condition, surgery or mental health condition prevents a person from performing the duties of the job. Every plan is different, so patients should review the summary plan description or contact human resources or the insurance carrier.

Frequently asked questions
Is FMLA paid leave?
FMLA itself generally provides unpaid, job protected leave. An employee may be able to use paid time off, sick leave or short term disability benefits at the same time, depending on the employer’s policies and the disability plan.
Can telehealth doctors fill out FMLA forms?
A qualified clinician may complete medical certification when the clinician has enough information to make a medically sound assessment. An employer or insurer may have additional documentation requirements, and some medical situations are not appropriate for telehealth alone.
Can anxiety, depression or another mental health condition qualify?
A mental health condition may qualify as an FMLA serious health condition when it meets the applicable requirements, such as inpatient care or continuing treatment and related incapacity. Short term disability coverage depends on the plan.
How quickly should I return FMLA certification?
The U.S. Department of Labor states that an employer generally must allow at least 15 calendar days after requesting certification, unless it is not practicable despite diligent, good faith efforts. Check the date on your employer’s notice and act promptly.
Who approves my leave or disability claim?
The employer determines FMLA eligibility and designation. The employer, plan administrator or insurance carrier determines short term disability benefits. The medical clinician documents health information and functional limitations but does not control the final decision.
Does Texas require every private employer to offer paid medical leave?
No. Texas generally does not require private employers to provide paid sick or family leave. Federal FMLA, disability accommodation laws, employer policies, insurance plans or other protections may still apply depending on the circumstances.
